Terms of Service

These Terms of Service ("Terms") govern your use of the Captain Stay website and, when available, our mobile application and marketplace platform (collectively, the "Service"), operated by Captain Stay LLC ("Captain Stay", "we", "us"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. About Captain Stay

Captain Stay is a peer-to-peer boat-rental marketplace that connects boat owners ("Owners") with renters ("Renters") in the United States. The Service is currently in pre-launch; full transactional features will be available upon launch in 2026. Currently, the Service allows you to join a waitlist for early access.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use the Service. By using the Service you represent and warrant that you meet these requirements.

3. Waitlist

By joining our waitlist you agree to receive email communications from Captain Stay about our launch, early-access openings, and updates relevant to your selected market. You may unsubscribe at any time. We do not guarantee any specific launch date or that you will receive early access.

4. Platform role

Captain Stay is a marketplace and technology platform. We are not a boat rental company, marine operator, insurance provider, or party to any rental agreement between Owners and Renters. When the marketplace launches, all rental agreements are between the Owner and Renter directly; Captain Stay facilitates the connection and payment only.

5. Payments (at launch)

When the marketplace is live, payments will be processed securely via Stripe. Owners will receive 85% of the booking amount after the trip is completed and any applicable hold period has elapsed. Captain Stay retains a 15% platform fee. Full payment terms will be provided at launch.

6. Owner responsibilities (at launch)

• Ensure your vessel is seaworthy, properly documented, and covered by valid marine insurance for the type of rental offered.
• Provide accurate listings including the vessel's condition, capacity, and any applicable rules.
• Comply with all applicable US Coast Guard regulations and state and local maritime laws.

7. Renter responsibilities (at launch)

• Hold any required boating licence or certification for the vessel and waters you are renting on.
• Follow all safety instructions provided by the Owner and applicable laws.
• Return the vessel in the same condition it was received.

8. Prohibited conduct

• Using the Service for any unlawful purpose.
• Providing false or misleading information in listings or profiles.
• Circumventing the platform to conduct off-platform transactions with users you met through Captain Stay.
• Interfering with the security or integrity of the Service.

9. Intellectual property

All content on the Captain Stay website — including text, graphics, logos, and software — is the property of Captain Stay LLC or its licensors and is protected by US copyright and trademark law. You may not reproduce or redistribute it without our written permission.

10. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or secure, or that any information on the Service is accurate or complete.

11. Limitation of liability

To the maximum extent permitted by law, Captain Stay LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed $100 USD.

12. Indemnification

You agree to indemnify and hold harmless Captain Stay LLC and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing law & disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved by binding individual arbitration under the American Arbitration Association rules; class actions are waived to the fullest extent permitted by law.

14. Changes to these Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected in the "Last updated" date above.
